[Cyprus Times] Audit Report: "Office of the Commissioner of Administration in a building without a certificate of approval"

The Special Report on "Audit of the Office of the Commissioner for Administration and Human Rights Protection" has been made public, prepared by the Audit Office and posted, on Friday, on the Office's website.

According to its Report, based on the findings of the compliance audit, the Audit Office concludes that the Office of the Commissioner for Administration and Protection of Human Rights continues to be housed in a building which does not have a Certificate of Approval, which is, according to an opinion of the Attorney General, illegal.

In its Special Report, the Audit Office makes recommendations, stressing that the Commissioner must respect the principle of legality in relation to procedures concerning the rental of buildings.

According to the findings of the Audit Service, the GEDPAD continues to be housed in a building which does not have a Certificate of Approval, despite the opinion of the Attorney General of the Republic that this constitutes an unquestionable illegality, which renders the rental contract null and void.

Furthermore, in the Supplementary Agreement signed on 23.2.2018, for renewal of the rental period, between the Commissioner and the owner, it is expressly stated that the contract will continue to be valid as long as the Certificate of Approval of the building is secured until 31.12.2018.



The Audit Office states in its Report that the Certificate of Approval, according to this agreement, "is an essential condition for renewal of the contract and if it is not secured, the tenant has the right to terminate the contract."

"To date," it adds, "the Certificate of Approval has not been issued."
