The Supreme Court accepted an appeal filed by the Attorney General of the Republic Mr. George Savvidis against a 2.5-year prison sentence imposed on a defendant who intentionally caused grievous bodily harm to a woman with whom he had previously had a love affair by shooting her twice with a shotgun.
Agreeing with the Prosecutor General's position that the original sentence of 2.5 years' imprisonment imposed by the Larnaca - Famagusta Permanent Criminal Court was manifestly inadequate and the consequent need to impose deterrent sentences, the Supreme Court, taking into account the seriousness of the offence as well as the facts of the case, set aside the original judgment and imposed a 7-year prison sentence on the accused.
As, inter alia, the Supreme Court noted in its judgment, the accused "[...] acted cowardly, vindictively and without hesitation [...]. It was a brutal and unprovoked use of violence against a fellow human being", and therefore "[...] the sentence imposed by the Criminal Court eliminated both the element of gravity and the element of deterrence". As also indicated by the Supreme Court, a woman has the right to choose her sexual partners and the right to terminate her relationship with them, which the defendant did not respect.
