[PIO] Publication of EU Weekly Notifications of Unsafe Products notified in the RAPEX Safety Gate System

The Consumer Protection Service (CPC) of the Ministry of Energy, Trade and Industry, as the competent authority in Cyprus for the operation and management of the European Rapid Information Exchange System on Dangerous Non-Food Products, informs consumers that during the week starting 22/04/24 (RAPEX - Report 17) 63 products presenting a risk to their health and safety have been notified to the System. These products were identified on the markets of several European Union (EU) Member States and subsequently notified to the RAPEX Safety Gate System.

Consumers can find out about the dangerous products on the website.

The 63 products were allocated for market surveillance purposes as follows:

  1. Six (6) to the Consumer Protection Service, with one (1) of them having been notified to the system by Cyprus.
  2. Twenty-four (24) to the Department of Pharmaceutical Services.
  3. Thirteen (13) in the Department of Labour Inspection.
  4. Nine (9) in the Department of Environment.
  5. Five (5) in the Department of Road Transport.
  6. Three (3) in the Department of Electrical Engineering Services.
  7. Three (3) in the Mining Department.

The products relevant to the Consumer Protection Service, and the corresponding associated risks, are described in this table.

Please note that products with serial numbers 1 to 5 have been assessed by the European Commission as posing a serious risk, while product number 6 has been assessed by the European Commission as posing a lower risk.

It is noted that of these six (6) products, one (1) has been initially identified by the GPSD in the Cyprus market (without having been previously identified in the other Member States) and has proceeded to its freezing and withdrawal.

The remaining products are likely to be on the Cyprus market and pose a direct threat to the health and safety of consumers, in particular children. The CPS has already started intensive market checks to identify the products.

The Consumer Protection Service calls on importers, distributors and sellers who may have such products available to immediately stop supplying them and notify the Service.

The Consumer Protection Service also invites consumers, in case they possess the above products, to stop using them and return them to the seller, i.e. to the store where they were purchased, and at the same time inform the seller accordingly.

It should be noted that, according to the Consumer Protection Law of 2021, in case of purchase of an unsafe product, the consumer is entitled to a replacement of the product, so that the product complies with the terms of the sales contract. If this is not possible, then the consumer is entitled to withdraw, i.e. to return the product to the seller and receive a refund of the full amount paid. It is recalled that the above rights are valid for a period of two years from the initial delivery of the product to the consumer and that the final seller is always solely responsible towards the consumer.

In the event that the seller refuses to comply with the above rights of the consumer, the consumer is invited to submit a written complaint via the website of the Consumer Protection Service.
