[PIO] Press Release of the Parliamentary Committee on Legal Affairs, Justice and Public Order

The Parliamentary Committee on Legal Affairs, Justice and Public Order met today, Wednesday, 23 February 2022, and discussed the following issues:

1. The problems encountered in the implementation of the i-justice

(Self-examination following the recommendation of Mr. Costis Efstathiou)

The Commission began the discussion of the above matter, which was registered under the ex officio procedure, in the presence of representatives of the Ministry of Justice and Public Order, the State Ministry of Research, Innovation and Digital Policy, and the Legal Service of the Republic. The subject of the discussion was the problems arising from the implementation of the i-justice system and in particular issues relating to the institutional role of court records, compliance with registration deadlines and the possibility of physical registration of documents.

2. The Lawyers (Amendment) Law of 2022.

(Bill proposed by Mr. Nikos Tornaritis, on behalf of the Parliamentary Group of the Democratic Rally, and Ms. Christiana Erotokritou, on behalf of the Parliamentary Group of the Democratic Party)

The Committee began discussion of the above proposed legislation, the purpose of which is to amend the Lawyers Act to delete the provision making it a disciplinary offence to receive a fee less than the minimum specified by the Regulations in force from time to time.

According to the drafters of the proposed law, this provision has become obsolete, since the resolution of disputes arising from the provision of legal services, as well as the criteria for attorney's fees, are now regulated by the provisions of the Resolution of Disputes Arising from the Provision of Services by Attorneys (Out-of-Court Cases) Regulations.

The Committee heard the views of those concerned and, having concluded the discussion both in principle and in substance, decided to take a position on its provisions at its next meeting.

3. a. The Prisons Act of 2019

The Committee continued its discussion of the above draft laws, the purpose of which is to comprehensively replace the existing Prisons legislation in order to bring it in line with modern concepts of serving sentences and internationally prevailing principles on the treatment of prisoners. In this context, the Commission proceeded to an article-by-article discussion of the provisions of the Bill in the presence of the stakeholders, which will be continued at its next meeting.

4. a. The Commercial Court and Admiralty Court Act of 2019

b. The Courts (Amendment) Act, 2019.

The Committee decided to defer the placement on the provisions of the above bills.

5. The Third Amendment to the Constitution Act, 2022.

The Committee decided to defer placement on the provisions of the above bills.

6. a. The Police (General) (Amendment) (No. 2) Regulations, 2021.

b. The Special Police Officers (Appointment Procedure and Conditions of Service) (Amendment) Regulations, 2021.

The Committee, having taken a position on the provisions of the above Regulations, resolved that they be referred to the full House.

7. The Combating Terrorism and Protection of Victims (Amendment) Act, 2021

The Committee decided to refer the above Bill to the House in plenary, after a round of consultation on amendments expected to be tabled by Members in accordance with the Rules.
