The work of the CSTO's Committee on Legal and Human Rights concluded on Friday 8 September in Paris. During the meeting, the Rapporteur of the Committee on the issue of the enforcement of ECtHR judgments, Mr Kostis Efstathiou, presented an introductory memorandum. In his statement, the Rapporteur focused on the two main themes of the 12th Report, namely, the importance of monitoring the execution of the most important cases pending before the ECtHR and the importance that will now be attached to cases concerning the strengthening of democratic principles and the effective fight against arbitrariness, corruption and abuse of power in the Member States.
A hearing was also held on the ways and means available to the Council of Europe and the CSCE in particular to ensure faster and more effective compliance by Member States with ECtHR judgments. Particularly problematic, as mentioned, is the Court's unimplemented judgment on Osman Kavala. It was pointed out that, despite the Court's constant reminders, the activist and well-known human rights defender remains in detention due to Turkey's persistent refusal to comply with its treaty obligations. It was underlined that the attitude of this country raises a credibility issue for the Organization itself, despite the invocation of Article 46 of the European Convention on Human Rights, which provides for the measures that the Committee of Ministers may take in the event of non-recognition of the obligation to enforce decisions.
Mr Efstathiou also presented the motion for a resolution tabled by members of the Socialist Group on the issue of the detention of activist and whistleblower Mr. Julian Assange and the legal and political issues raised.
Finally, Mr Efstathiou was appointed on behalf of the Legal and Human Rights Committee as Rapporteur for an Opinion on the issue of child abuse in Europe.
