[PIO] Court of Appeal upholds the appeal of the Attorney General of the Republic against the imprisonment of a defendant accused in a case of aiding

The Court of Appeal increased to three years the 18-month prison sentence imposed at first instance on a defendant who was found guilty after admitting to a number of charges, the most serious of which were assisting third country nationals to stay illegally in the Republic and money laundering. The decision of the Court of Appeal was taken following an appeal filed by the Attorney General of the Republic, Mr George Savvidis, for a manifestly inadequate sentence, based on the seriousness of the offences, the prescribed sentence, case law and the need for general prevention and deterrence.

The case concerns two incidents of assisting a total of five aliens that occurred in late 2021, with the defendant being a person who had arrived in Cyprus through the occupied territories.

This is the first case to be heard at the Court of Appeal level following the amendment of the Aliens and Immigration (Amendment) Law of 2021 (46(I)/2021) and the increase in penalties. Indicative of this is the particular reference made in the Court of Appeal Judgment as to the seriousness of the offences, the ever-increasing frequency with which such cases are presented before the court, and the legislative amendments that have been made that relate to an increase in the penalties for such offences.
