[PIO] Convictions and sentences for breaches of the Occupational Safety and Health Legislation

The Labour Inspection Department of the Ministry of Labour and Social Insurance, promoted the prosecution of the companies H.M. INSTALLATIONS LTD and CH. GIANNAKI TRADING LTD for violating the provisions of the Legislation on Occupational Safety and Health.

As a result of the prosecution, the Larnaca District Court sentenced H.M. INSTALLATIONS LTD, which is engaged, inter alia, in the replacement of advertising banners on billboards, to a total fine of €8,000 for the following violation of the Occupational Safety and Health Laws, which caused the injury of an employee:

(a) Failure to provide a safe method of work, namely to determine the location where a telescopic hoist was to be placed/installed in order to be at a safe distance from the medium voltage (11000 Volts) overhead lines of the Cyprus Electricity Authority (CPE), as a result of which the telescopic hoist came into contact with the medium voltage (11000 Volts) cables and its employee, who was with other employees and working inside the hoist cage, was electrocuted and injured.

The Court also sentenced CH. GIANNAKI TRADING LTD, a company engaged, inter alia, in retail operations and forklift rental services with its operator, to a total fine of €8,000 for the following violation of the Occupational Safety and Health Laws, which caused the injury of an employee of another company:

(a) Failure to provide proper information, instructions and supervision to its employee and telescopic hoist operator to place/install a hoist at a safe distance from the medium voltage (11000 Volts) overhead lines of AEC, while performing work to replace an advertising banner on a metal sign by employees of another company, as a result of which the hoist came into contact with the overhead lines and an employee of another company, who was in the metal cage of the hoist, was electrocuted and injured.

The Court also fined two individuals €500 each for breaches of the Occupational Safety and Health Act and the Occupational Safety and Health Management Regulations.
