The Labour Inspection Department of the Ministry of Labour and Social Insurance promoted the criminal prosecution of a natural person and the company HARCO TRADING LTD for violating the provisions of the Legislation on Occupational Safety and Health.
As a result of the prosecution, the Nicosia District Court sentenced a natural person who was an employer to a total fine of €2,000 and a 4-month prison sentence suspended for 3 years, for the following violations of the Health and Safety Laws, which caused the fatal injury of his employee and endangered his employees and other persons:
(a) Failure to ensure the safety and health of his employees during the installation of a metal pallet storage system for pallets of goods in a warehouse under renovation, resulting in his employee falling from a height and fatally injuring himself.
(b) Failure to implement an appropriate safety system or risk management system that describes, inter alia, arrangements for the effective planning, organization, control, and monitoring and review of preventive and protective measures to be taken for hazardous workplace activities.
[C] Failure to have available to him a written risk assessment on the basis of which preventive and protective measures to deal with the risks arising from his activities are determined.
[D] Failure to insure with any insurer against liability for accident or occupational disease to any of his employees.
The Court also fined HARCO TRAIDING LTD, as the developer/warehouse owner, a total of €6,000 for the following breach of the Health and Safety Acts which put persons at work at risk:
(a) Failure to ensure that the individual who undertook the work of refurbishing his warehouse had an appropriate safety system in place and appropriate and adequate written risk assessments.
