The Ministry of Labour and Social Insurance announces that the 13th salary, where it is paid under a collective agreement or personal contract or as a practice of the enterprise, constitutes part of the employee's salary and therefore its non-payment amounts to a violation of the provisions of the Wage Protection Act.
This, in addition to the rights granted by the Law to the employee to claim civilly for payment, constitutes a criminal offence and results in the criminal prosecution of the employer. Under the provisions of the said Law, upon conviction of the employer, the employer is liable to imprisonment for up to six months or a fine of up to €15,000 or both penalties together.
In addition, the competent Court may award employees the amounts due to them corresponding to the 13th salary.
