In the framework of the educational programmes of the Cyprus Bar Association, and in the context of the productive cooperation between the Cyprus Bar Association and the Office of the Law Commissioner on the basis of the Memorandum of Cooperation between them, the Office of the Law Commissioner participated in the training programme "Training of Lawyers on European Law relating to vulnerable groups of migrants (TRALVU)", held on 29 September 2023 in Limassol.
The Law Commissioner's Office participated in the training programme, presenting the main topic of the programme, entitled "The European Framework (EU, CoE, ECtHR) in relation with vulnerable migrants". The representative of the Legislation Commissioner's Office, lawyer Mr. Antonis Serov, presented the different aspects of the European legal framework (EU, CoE, ECtHR) in relation to different categories of vulnerable applicants/beneficiaries of international protection and migrants.
In particular, the presentation was divided into the following two parts: the inherent vulnerability of applicants/beneficiaries of international protection/migrants as a group on the one hand and the vulnerability of certain categories of applicants/beneficiaries of international protection/migrants on the other hand.
With regard to the second part (the vulnerability of certain categories of applicants/beneficiaries of international protection/migrants), the presentation first covered the EU legislative framework concerning certain categories of vulnerable applicants/beneficiaries of international protection and migrants, focusing on Directives 2011/95/EU (Qualifications Directive), 2013/32/EU (Asylum Procedures Directive), 2013/33/EU (Reception Conditions Directive) and Directive 2011/36/EU (Anti-Trafficking Directive) of the European Parliament and of the Council, focusing on the following categories of vulnerable applicants/beneficiaries of international protection and migrants: unaccompanied minors and victims of trafficking in human beings.
Subsequently, the presentation analysed the legislative framework of the Council of Europe, focusing on the European Social Charter, the relevant decisions of the European Committee of Social Rights regarding unaccompanied minor applicants/beneficiaries of international protection/migrants, and the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention) with regard to applicants/beneficiaries of international protection/migrants who are victims of gender-based violence.
Finally, the presentation analysed specific decisions of the European Court of Human Rights regarding vulnerable applicants/beneficiaries of international protection/immigrants and in particular violations of Articles 3 and 5 of the European Convention on Human Rights.
We would like to thank the Pancyprian Bar Association for the invitation. We consider that such seminars are now necessary for the effective and correct compliance of the Republic of Cyprus with the European legislative framework but also for the training of lawyers and legal practitioners.
The Office of the Commissioner for Legislation remains at the disposal of the Pancyprian Bar Association in these programmes and trainings and generally in any matter concerning the Memorandum of Understanding between them.
