The Labour Inspection Department of the Ministry of Labour and Social Insurance has promoted the criminal prosecution of the company PEPSIS AND YIOS ERGOLITIKI LTD, which violated the provisions of the Legislation on Occupational Safety and Health.
As a result of the prosecution, the Nicosia District Court sentenced the company PEPSIS AND YIOS CONSTRUCTION LTD, which is active, inter alia, in the execution of road construction and land division works, to a total fine of €35.000 for the following infringements of the Safety and Health (Minimum Standards for Temporary or Mobile Construction Sites) Regulations, which caused the fatal injury of one of its employees and endangered its employees:
(a) Failure to take the necessary precautions in the excavation, namely (a) placing proper shoring along the slope of the excavation and/or (b) forming a proper slope of the slope by creating terraces resulting in a landslide of the slopes and fatal injury to its employee, who was in the manhole and was crushed by masses of earth that had collapsed from one side of the manhole (excavation).
(b) Failure to provide proper instructions, adequate training, and supervision for well drilling operations over 2.5m deep.
The Court also sentenced an individual to 6 months imprisonment suspended for 3 years for breaches of the Health and Safety (Minimum Standards for Temporary or Mobile Construction Sites) Regulations.
