On 26 September 2023, the Supreme Constitutional Court issued an opinion on Petition No. 2/2023 submitted by the President of the Republic under Article 140 of the Constitution, regarding the constitutionality of the Law passed by the House of Representatives on 30 March 2023, entitled "The Turkish Cypriot Properties (Management and Other Matters) (Provisional Provisions) (Amendment) (No. 2) Law of 2023". In this regard, it was held that the said law is not in conflict or inconsistent with the provisions of Articles 80.2 and 179 of the Constitution.
The purpose of the adopted law is to establish an obligation for the Custodian of Turkish Cypriot Properties to ensure the preparation of a study regarding the structural adequacy of a Turkish Cypriot property before granting a licence to use it to a beneficiary for housing or business purposes.
According to the relevant opinion, the House of Representatives acted within its powers and no interference in any way with the powers of the Executive Power or violation of the constitutional principle of separation of powers was found.
The lawyers A. S. Angelides and S. A. S. Angelides appeared for the House. In the light of the above, the Law in question will be adopted by publication in the Official Gazette of the Republic.
