The General Accounting Office of the Republic (GAO) notes that the management of this project from the contracting stage until the termination of the relevant contract was carried out within the framework of the current legislative and regulatory framework, and taking into account the importance of the project and the public interest.
In particular, and in relation to the conclusions and recommendations of the Audit Office, the following are noted:
- The time for submission of tenders had been extended for a total period of more than three months, which was considered satisfactory in view of the modifications and clarifications provided by the GAO in the context of the tender procedure.
- Prior to defining the requirements for the tendering process, the GVA carried out a market survey in which presentations were made by interested parties on the capabilities of their systems, which were taken into account when finalising the requirements, and technical support was obtained from external consultants. It is also mentioned that in the context of the implementation of the contract, the design of the system was, as usual, carried out in cooperation with the contractor's specialised consultants.
- The procedure for evaluating the submitted tenders was carried out in accordance with the regulatory framework and included, inter alia, obtaining feedback from the tenderers' customers.
- During the implementation of the project, the GPA was fully aware of the problems that occasionally arose and, precisely because of the great importance of the project, showed the necessary flexibility and managed the problems with the public interest in mind, evaluating in each case the alternatives, always within the framework of the applicable legal framework.
- Given that 'the Contractor has demonstrably failed to fulfill its contractual obligations', as noted in the Special Report under reference, the GOL is already taking the necessary measures in accordance with the provisions of CPR 138/2016.
Following the termination of the contract in question, the GAO, taking into account the challenges encountered during the implementation of the project, proceeded to design the strategy to upgrade and replace the existing systems on a phased basis in order to reduce risks during their design, implementation and enforcement.
