On 7/6/2024, a working visit by the European Lawyers Foundation and the Paris Bar Associations took place at the Office of the Commissioner for Legislation, Athens Bar Association, National Council of Polish Bar Associations, National Council of Italian Lawyers and Irish Bar Association in the framework of the TRALIM 3 - Training of Lawyers on EU Immigration and Asylum Law 3 project.
This visit took place within the framework of the cooperation between the Office of the Commissioner for Legislation and the Cyprus Bar Association participating in the European co-funded project TRALIM 3.
The Law Commissioner Mrs Louisa Christodoulides Zannetou made a presentation entitled "The Work of the Law Commissioner of the Republic of Cyprus in the field of Asylum", during which she explained to those present the role played by the Law Commissioner's Office in shaping the Law of Asylum. In particular, he explained the evolution of the Office as an institution of the Republic, explaining its present status, the duties of the Commissioner and the general role of the Office in the context of the executive power. In addition, he explained the Office's involvement in the reform of the Cyprus Law, focusing on the recast of the Refugee Law as the main development in the field of Asylum Law.
He then expanded on the duties of the Office of the Commissioner for Legislation regarding the preparation, presentation and support of National Reports, which the Republic is obliged to submit in accordance with the ratified Human Rights Conventions within the framework of the United Nations and the Council of Europe. This task is interlinked with the protection of the Human Rights of applicants and beneficiaries of international protection in the Republic. In conclusion, the Commissioner presented the establishment of the Deputy Ministry of Immigration and International Protection as a decisive development in the field of Asylum Law in the Republic.
Subsequently, an official of the Legislation Commissioner's Office presented how the legislative framework of Asylum Law is taking shape in Cyprus and in Europe. In particular, he explained the need to recast the Refugee Law of 2000 (Law 6(I)/2000), while summarising specific proposed reforms to this Law. He then presented the establishment of the Ministry of State for Migration and International Protection, linking this development with similar bodies established in other Member States of the European Union. He also briefly mentioned the establishment of the Administrative Court for International Protection through the Law on the Establishment and Operation of the Administrative Court for International Protection of 2018 (Law 73(I)/2018).
In conclusion, he presented indicative changes from the European Union's Migration and Asylum Pact regarding the protection measures provided by the Asylum Procedure Regulation with regard to vulnerable migrants, focusing on unaccompanied minors.
This was followed by a highly productive discussion among the participants on the evolution of Asylum Law in Europe. In particular, the participating lawyers presented the developments in their countries regarding the revision of Immigration and Asylum Law, where good practices from Ireland, France and Spain were documented.
In conclusion, the Office of the Law Commissioner expresses its thanks to the Cyprus Bar Association and the European Lawyers Foundation for organising this visit and considers such training seminars and meetings to be of catalytic importance for the training of lawyers in European Asylum and Immigration Law, and in the protection of the rights of applicants and beneficiaries of international protection, as they derive from the relevant legal frameworks.
