Following the adoption by the House of Representatives, the amendments to the Fisheries Law (Chapter 135) and the Law 134(I)/2006 on the Implementation of Community Decisions in the Field of Fisheries shall enter into force. These amendments aim at adjusting the maximum penalties that can be applied for infringements and offences in order to make the control system more effective in combating and deterring illegal, unreported and unregulated fishing.
The main changes concern the increase of the maximum amount for fisheries-related offences. Now, most offences involving fishing offences in the territorial waters of the Republic of Cyprus have a maximum penalty of €50,000 from €8,500 previously, while for marine pollution the maximum penalty has been increased from €50,000 to €100,000.
In addition, for serious infringements involving illegal, illegal and unregulated fishing, as well as for infringements in the Exclusive Economic Zone (EEZ) and outside the waters of the Republic of Cyprus, the penalties can reach up to €400,000. For infringements relating to the European Union's Common Fisheries Policy (CFP), the scope for the court to impose confiscation is widened. In comparison, the court can even order the confiscation of a vessel used in the commission of an offence referred to in Law 134(I) of 2006 until 2024.
This announcement is published today on the occasion of the International Day against Illegal, Unreported and Unregulated Fishing, thus underlining the commitment of the Republic of Cyprus to protect our seas and promote sustainable fishing.
These laws were published in the Official Gazette of the Republic of Cyprus, dated 31/5/2024, and can be found at website of the Department of Fisheries and Marine Research.
