A 38-year-old Egyptian man is being tried before the Mixed Jury Court of the Dodecanese Court of Appeal, who allegedly molested his partner's 13-year-old daughter for three years.
The latter is even accused of complicity in these acts.
The background of the case.She complained, in the presence of a child psychologist, that her mother's partner had been molesting her for about three years and that her mother knew and did not prevent him from doing so.
The minor's parents separated in 2019 while her mother had entered into a sexual relationship with the defendant.
The minor had been living with her mother and her partner as well as her two siblings since April 2019. The minor had her own bedroom.
The minor's father lived with a new partner in another house and had no knowledge of his daughter's daily life because he was a sailor.
The relationship between the mother's partner and the minor was initially very good. However, after he gained her trust he allegedly identified her vulnerability due to the absence of a father role model one day in April 2019, in his own home, he left the bed where she was sleeping with the mother and on a mattress on the ground where the minor was sleeping, he molested her.
When they then all moved into a shared residence and while the minor was alone in her room at night, the defendant entered inside and molested her.
These acts allegedly continued for many nights thereafter and almost daily, when he had no business obligations and was staying at their shared residence, he raped her.
The minor allegedly confided in her father about what happened two years before she went to the police.
Her father, alarmed, spoke to her mother about what the child confided in him, but the accused/mother denied it.
Her mother, initially having some doubts, one night when the accused was not in their bedroom, followed him to her daughter's room, where she saw him without clothes from the waist down, interrupting him in this way, before he molested the minor by getting into a violent confrontation with him.
Despite the above incident, the mother's refusal to believe the allegations of her minor daughter, continued and allegedly provided a fertile ground for the continuation of the accused's illegal conduct, which he covered up.
The mother, despite her disbelief regarding her minor daughter's allegations, allegedly, according to the respondent, placed a deadbolt on her bedroom door to prevent any unlawful conduct by the accused against her. However, according to the minor's allegations, the man's actions continued even after the latch was placed, as the defendant broke the door of her room after an argument.
Subsequently, in April 2021, while the minor's father was on a business trip, he received a phone call from his partner, who told him that his daughter had reported the incidents she had mentioned to him in the past.
The minor was examined by a gynaecologist and it was found that her hymen had ruptured.
Both defendants attribute the minor's crime to their persistent refusal to accept her having a sexual relationship with a 19-year-old man and to the fact that she often wanted to stay out of the house with friends who did not approve.
The jury found that none of the defendants provided convincing reasons why a latch was placed in the minor's room. And the first defendant's claim that it was placed on his own initiative in order to prevent the minor from claiming that he was molesting her, was held not to stand the test of reason, since as he said, he was surprised by the allegations of the plaintiff and he himself asked to go to the police and the hospital because he would not tolerate being accused.
