The Plenum meets in an extraordinary session on Tuesday, 4 January 2022, at 11.00 the plenary session of the Parliament to take a position on the referral of the law on reduced VAT rate to 9% for the supply of electricity.
One hour earlier at 10.00 the Parliamentary Finance Committee will hold an extraordinary session to examine the reasons for the referral. Finance Minister Konstantinos Petridis and Attorney General George Savvidis have been invited to attend the session
The referred law was passed by the Plenum of the Parliament on 3 December and was referred back to the Parliament on 22 December.
In the reasons for the referral, the President of the Republic states that the law referred back violates EU law and also the Principle of Separation of Powers.
He adds that the reasons for the referral are economic and financial, since it is considered that the adoption of the law will have a major impact on public finances and will derail the State's budgetary commitments and objectives, since it is a measure with a horizontal application for which no timeframe for implementation has been set. As stated, the loss is expected to amount to approximately EUR 75 million over a period of one year based on the AHK's VAT receipts.
It also states that in substance the Revoked Law interferes with and modifies fiscal policy, which is subject to the obligations of Union law and is contrary to the relevant provisions of the Constitution, namely Article 167.
It takes the position that the House of Representatives, through the adoption of laws that substantially affect the planning of fiscal policy, interferes with the Executive's attempt to fulfil its fiscal obligations in accordance with Union law and recommends that the House of Representatives should not adhere to its decision by accepting the Impeachment.
