Commission President Ursula von der Leyen announced the activation of the mechanism to protect the European Union's budget from Member States violating the rule of law against Hungary from the floor of the European Parliament on Tuesday.

In particular, Ms. von der Leyen said that the Hungarian government had been informed of the decision after examining Hungary's replies to a letter from the Commission in which Brussels asked for more information on rule of law issues.

"We have carefully examined the answers to these questions. Our conclusion was that we have to go to the next step," the Commission President said.

This follows the ruling of the EU Court of Justice a few weeks ago that the mechanism is compatible with the EU Treaties.

Under the mechanism's operating rules, the procedure is triggered by the Commission, but it is the EU Council that will take the final decision by qualified majority, meaning thatthe decision to cut funds must be taken by 55% of member states representing at least 65% of the total EU population.
