The Supreme Court has acquitted a man who was sentenced to 48 months in prison after being found guilty of engaging in a sexual act with a child using coercion, force or threat but gave him a two-year sentence on charges of engaging in a sexual act with a child under the age of consent.
The recent decision followed an appeal by the convicted man against the original judgment where he was given a concurrent 48-month prison sentence, on the more serious charges he faced, for engaging in a sexual act with a child using coercion, force or threat to which he had not admitted guilt. The trial court had not sentenced him for the charges of engaging in a sexual act with a child below the age of consent.
