The Supreme Court dismissed the appeal of the Tender Review Authority in a case concerning the construction, operation and maintenance of the new Paphos-Polis Chrysochous road on a DBFO basis, upholding the decision of the Administrative Court, in favour of a consortium, which had held that the constitution and composition of the Management Committee was flawed on grounds relating to the participation of third parties.
In its judgment, the Supreme Court held that the arguments of the appellant's side were not well-founded and that the first instance judgment was correct, adding that in the present case, the fact that the act of appointment of the management committee included a person who is not included among those whom the law provides that the management committee must comprise makes it unlawful the constitution of the management committee
