Following an appeal filed by the Attorney General of the Republic, the acquittal of a first instance court against a person arrested for possession and supply of drugs has been overturned.
The Court of Appeal, setting aside the Court's first instance judgment and accepting the position of the Attorney General of the Republic that, based on the findings of the first instance Court, the Court should have convicted rather than acquitted the accused, stated that the first instance Court had erroneously acquitted the accused of the offences with which he was charged.
Therefore, as noted in the judgment of the Court of Appeal, the trial court judgment is set aside and replaced with a judgment of conviction against the accused as he is found guilty of the charges he faced. The defendant was then sentenced to immediate 7 months' imprisonment, with the Court of Appeal noting the seriousness of the offences and the importance of deterrence. The Court of Appeal's reference is characteristic:
"Undoubtedly, the concern of the legislature about the spread and dispersion of drugs is shared by the domestic courts of all levels, which, within the framework of their own competences, participate in the effort to eradicate them. The Supreme Court has had the opportunity, on many occasions in recent years, to stress the urgent need for the imposition of severe and dissuasive penalties in the context of efforts to combat the scourge of drugs."
