The Court of Appeal upheld the appeal of the Attorney General of the Republic

The Court of Appeal ruled that the appointment of Ms Loukia Christodoulou as President of the Competition Protection Committee for the period from 24 April 2018 to 23 April 2023 was lawful, thus upholding the appeal filed by the Attorney General of the Republic against the decision of the Administrative Court, which held that the renewal of Ms Christodoulou's term of office as President of the Competition Protection Committee was not in accordance with the Law on Protection of Competition.

According to the judgment of the Court of Appeal issued today, the appointment of Ms Loukia Christodoulou as President of the Competition Protection Committee is within the limits of the Law, since "the period of appointment of a person, either as a member or as President, is measured separately, with the possibility of a specific maximum period of holding each separate position, since the positions are distinct". Accordingly, the Court of Appeal set aside the judgment of the Court of First Instance, awarding costs to the applicants.

The above judgment of the Court of Appeal resolves the issue of the validity of the constitution of the Competition Protection Committee in so far as it relates to its Chairman at the material time, and resolves the issue which has been the subject of a number of cases before the Administrative Court.
