[PIO] Legal Service Conclusions from the analysis for 2023 of the appeals registered against the Republic by asylum seekers and others

Statistics of the Appeals Subsection of the Administrative Tribunal for International Protection (Administrative Law Section) of the Legal Service

One of the competences of the Legal Service of the Republic, through the Appeals Subsection of the Administrative Tribunal for International Protection, is to represent and defend the Administration (Ministry of Interior, Asylum Service, Department of Population and Immigration Records) before all competent State Courts in appeals against the Republic filed by foreigners and asylum seekers. The contribution of the Legal Service is essential in managing the large number of cases filed against the Republic in the Courts as a result of the increased migration flows to the Republic.

The "Annual Statistical Analysis of the Administrative Court of International Protection and Administrative Court of Aliens Appeals Subsector, 2023" indicates the volume of work carried out by the Legal Service, with the main conclusions summarized as follows. For 2023, the Subsector handled a total of 10,001 new cases before the Supreme Court, the Court of Appeal, the Administrative Court and the Administrative Tribunal for International Protection

2. Before the Administrative Court for International Protection 8,377 new cases concerning asylum seekers were registered and before the Administrative Court 1,230 new appeals concerning aliens were received.

3. In 2023, 9,818 cases were processed before the Administrative Tribunal for International Protection of which only 45 cases have been successful, i.e. 0.46%.

4. From 2020 to 2023 there was a 472% increase

in new appeals registered before the Administrative Tribunal for International Protection. From 2022 to 2023 there was a 9% decrease in new appeals registered[/P]

5. The 76.53% of appeals registered before the AIPC concern applicants from safe countries. Applicants from safe countries decreased by 8.14% compared to 2022, while applicants from non-safe countries increased by 7.09%.

6. Appeals involving foreigners before the Administrative Court amounted to 65.25% of all appeals received in 2023.

7. The 71% of the decisions of the Administrative Court concerning foreigners were in favour of the Republic, while 29% were against the Republic.
