[PIO] Information campaigns on "Transparent and predictable employment conditions" and "Wage protection"

The Ministry of Labour and Social Insurance in cooperation with the Press and Information Office is organising public information campaigns on two new laws that strengthen the protection of workers' labour rights. The campaign starts today, 9 October 2023, and will run for two weeks.

In particular, the first part of the campaign concerns the new harmonisation law no. 25(I)/2023, which is in force from 16 April 2023 and harmonises national law with EU Directive 2019/1152. This Law aims to enhance the transparency and predictability of employees' terms and conditions of employment. Some of the most important provisions of the new Law are:

- the time given to the employer to inform the employee in relation to the terms of employment is reduced to seven days (instead of one month);

- the obligation to report on the components of remuneration in addition to the basic salary is established,

- in cases of non-fixed working hours, the employer must provide the employee with alternative information such as, inter alia, the framework of working hours within which employees may be required to work and guaranteed pay.

The second part of the campaign concerns the Wage Protection (Amendment) Act 2022 (Act. 221(I)/2022) which strengthens the protection of workers in relation to the payment of their wages, while also increasing the transparency of payroll:

- the strengthening of protection is achieved through the obligation of employers to pay wages by bank transfer or cheque, so that it is easier to prove the payment of wages. Exceptions to this obligation can only be made during the account opening process and where credit institutions have consistently refused to open accounts for employees or where employees are paid on a weekly basis, provided that this is provided for in a collective agreement or other written agreement.

- transparency is increased due to the obligation of each employer to prepare and send a payroll statement, by which the employee can know and claim his/her salary and contributions and control his/her deductions.
