[PIO] Elections 2024 - Conducting EXIT POLLs outside polling stations on election day

The Chief Electoral Officer announces that the conduct of exit polls (EXIT POLL) outside polling stations for the purpose of predicting the final election result on Election Day is not prohibited by the current electoral legislation, provided that their result shall be issued and announced in any event and only after the announcement by the Chief Electoral Officer that voting has been completed and the polls have been properly closed at all polling stations.

Therefore, those companies and television stations intending to conduct such polls are advised that any publication and announcement of the result of the poll before the polls close may result in the prosecution of their directors for violation of the relevant provisions of the Act for improper and unlawful influence and/or influence peddling to voters.

It is further stated that any person who attempts to directly or indirectly influence or coerce voters to vote or refrain from voting, or any person who attempts by fraudulent devices to obstruct the free exercise of the right to vote by voters, or misleads voters under various pretexts, commits the serious electoral offence of unlawfully influencing and influencing voters.

In violation of the Act, those responsible for conducting exit poll disclosures (EXIT POLL) may be charged with violating the secrecy of the ballot or obstructing the free exercise of voters' right to vote or coercion, mislead or unlawfully influence voters to cast or refrain from casting their vote, resulting, upon conviction, in a sentence of several months' imprisonment and/or a fine.
