[PIO] Conclusions of the Statistical Study of the work of the Administrative Court Appeals Subsector of the Legal Service, for 2023

The Administrative Court Appeals Subsection, Administrative Law Section, of the Legal Service represents the Republic before the Administrative Court, the Court of Appeal and the Supreme Constitutional Court in cases of appeals against decisions/actions/omissions of the Administration when it acts in the sphere of public law. These appeals mainly concern decisions taken by the Council of Ministers, the Ministries, the Public Service Commission, the Education Service Commission, the General Accounting Office of the Republic, the Tax Inspector and the Tax Board, the Town Planning, the Land Registry, the Police and the Army, the Council for the Release of Prisoners on Parole, but also independent authorities such as the Competition Protection Commission and the Office of the Commissioner for Personal Data Protection.

The "Annual Statistical Analysis of Decisions on Administrative Court Appeals and Appeals for 2023", indicates the work and contribution of the Subsector to the better and more efficient functioning of the administrative bodies of the State, with the main conclusions summarized as follows:

The main issues in dispute for 2023 concerned Appeals on decisions related to Civil Service Law, Urban Planning and Land Registry issues, Environmental issues, Military and Police issues, Tax Appeals, as well as Allowances and Allowances under relevant Legislation.

In more detail, in 2023:

1. 262 Administrative Court Decisions were issued on matters handled by the Subsector. Of these, 152 (58.02%) were rejected by the Administrative Court and 110 (41.98%) were successful. In 2022, the Administrative Tribunal issued 345 decisions, of which 240 (69.57%) were rejected and 105 (30.43%) were successful.

2. The percentage of Appeals filed against the Republic and rejected by the Court is about 60% and is at about the same level as in 2021 and 2020, with the exception of 2022, when it reached about 70%.

3. There were 78 appeals decided in the Court of Appeal, the Supreme Court and the Supreme Constitutional Court, as appropriate, where the Republic was a party, of which 62 were decided in favour of the Republic and 16 against the Republic. In 2022, the Supreme Court issued 47 decisions in appeals, of which 36 were decided in favour of the Republic and 11 against the Republic. 2023 is also the year in which, compared to the three-year period 2020-2022, the success rate of appeals in favour of the Republic was the highest. The appeals mainly concerned civil service matters and cases of the Ministry of Finance and the Ministry of Defence.
