[PIO] Communication from the Office of the Commissioner for Personal Data Protection regarding the photocertification scheme

The Office of the Privacy Commissioner has had ongoing consultation with the Police and the contractor who undertook the design and development of the photolocation system to ensure that its operation complies with the Traffic Offences (Use of Photolocation Devices and Other Related Matters) Act and the General Data Protection Regulation (GDPR).

The assistance of the Office of the Data Protection Commissioner concerned all stages of the operation of the system, from the taking of a photograph of a traffic offence to the payment of the bailiff's bill. Among other things, guidance was given on clearly distinguishing the roles of the Police and the Contractor and its subcontractors, on organisational and technical security measures, and on collecting information for the purpose of identifying the owner of the vehicle or the driver if the owner nominates another person.

As part of its obligations under the GDPR, the Police prepared and submitted to the Office of the Privacy Commissioner an impact assessment for this system. Having determined that, all comments submitted for guidance were taken into account and that the requirements of the GDPR were met, on Friday 10 December 2021, it was approved for operation.B-7]

On 1 January 2022, it is expected that the issuing of extrajudicial fines will commence after the relevant processing contracts have been signed and after a final inspection of the system has been carried out. Data collected or to be collected, prior to the signing of the contracts, as part of system testing will be destroyed. Although the system meets the requirements of the Photolabelling Act and the GDPR, the Police and the Contractor must be constantly vigilant. The Office of the Privacy Commissioner will continue to monitor the issue and provide guidance where and when needed.(N.G./IK)
