[PIO] Announcement of the Labour Inspection Department regarding convictions and penalties for violations of the Occupational Safety and Health

The Labour Inspection Department of the Ministry of Labour and Social Insurance promoted the criminal prosecution of the "Cyprus Electricity Authority", which violated the provisions of the Legislation on Occupational Safety and Health.

As a result of this prosecution, the Larnaca District Court sentenced the "Cyprus Electricity Authority", which is active, inter alia, in the generation, transmission and distribution of electricity, to a fine of €28.000 for the following infringements of the Minimum Safety and Health Standards (Use of Work Equipment at Work) Regulations and the Management of Safety and Health at Work Regulations, which caused fatal injury to one of its employees and endangered its employees and other persons:

(a) Failure to have a properly maintained basket lifter, which resulted, while her employee was engaged in pruning a palm tree and was in the basket of the above machine, at a height of approximately 4m, the machine suffered a mechanical failure, i.e. cutting/breaking of the pipe of the support arm, resulting in the sudden fall of the ball and the basket in which her employee was standing and his fatal injury.

(b) Failure to replace the worn pipe of the bracing arm of a basket lifter, resulting in her employee being engaged in pruning a palm tree and being in the basket of the above machine, at a height of about 4m, the machine suffered a mechanical failure, i.e., cutting/breaking of the support arm's pipe, resulting in the sudden fall of the ball and the basket in which her employee was lying and his fatal injury.

(c) Failure to conduct a periodic inspection of a basket lifter, in accordance with the manufacturer's instructions, resulting in her employee being engaged in the pruning of a palm tree and being in the basket of the above machine, at a height of approximately 4 m, the machine suffered a mechanical failure, i.e., cutting/breaking of the pipe of the support arm, resulting in the sudden fall of the ball and the basket in which her employee was lying and his fatal injury.

(d) Failure to implement an appropriate safety system or risk management system that described, in connection with the planned preventive maintenance of lifting equipment, the arrangements for the effective planning, organization, control, and monitoring and review of preventive and protective measures to be taken for workplace activities that create hazards, resulting in her employee being engaged in the pruning of a palm tree and b
