[PIO] Announcement of the Environment Department on the letter of complaint of the Cyprus Recycling Organisation

Regarding the announcement of the Cyprus Recycling Organisation (OAK), we inform you that following the passing of the Waste (Construction and Demolition Waste Management) Regulations of 2023 (KΔΠ 112/2023) by the House of Representatives, which were published on 13/4/2023 with immediate effect, the Environment Department took the following actions:

1. 1. Members of the OSEOC (3/5/2023).

ii. Holders of a certificate of registration in the Construction and Demolition Waste (C&DW) Manager's Registry for the collection/transfer of Waste from Construction and Demolition (C&DW) (31/5/2023).

iii. Stakeholders (6/16/2023 and 6/20/2023).

2. Publication in the official State Gazette, after consultation with all stakeholders, of the following forms in accordance with the new regulations:

i. Notification of the commencement of the execution of project works (KPI 214/2023), with notification of the date. 7/7/2023.

ii. Application for approval by the competent local authority of the construction site premises where the temporary storage of the WEEE will be carried out (CP 215/2023), with notification of the date of commencement of work (CP 215/2023). 7/7/2023.

iii. a Waste Management Plan (CP 252/2023), with notification dated 7/7/2023.

iii. a Waste Management Plan (CP 252/2023), with notification dated 7/7/2023. 4/8/2023.

iv. Certification of the proper management of the securities produced (KPI 253/2023), with notification dated 4.4.2013. 4/8/2023.

3. Preparation of relevant conditions for inclusion in Opinions/Reasoned Approvals/Recommendations.

4. Sending letters:

i. to the General Accounting Office (11/9/2023)

ii. to all concerned entities (26/9/2023),

enclosing conditions for the management of the LCAs when tendering for tenders relating to Technical or Construction Works, so that the documents are appropriately modified when tendering for tenders relating to Technical or Construction Works and the provisions of the legislation are applied.

iii. to the Collective Systems of the CRA (30/1/2024)

iv. to the President and Members of the Federation of Cyprus Building Contractors' Associations (OSEOC) (30/1/2024)

v. to the Chairman and Members of the Board of Registration and Control of Building and Engineering Contractors (30/1/2024),

underlining the obligations of project owners and waste producers/waste contractors to inform their members.

At the direction of the Minister of Agriculture, Rural Development and Environment, a campaign was conducted within March 2024, in accordance with the Waste (Management of Waste from Construction and Demolition) Regulations 2023 (CPR 112/20123) to project owners who produce LWD and/or LWD producers for compliance checks. During the campaign, more than 100 inspections of producers/contractors were carried out and 30 out-of-court settlements were issued for a total amount of EUR 21,000. The Environment Department continues to carry out inspections to crack down on illegal LWD discharges, where possible, as part of complaint investigations and/or on a sample basis at new projects per province.

It is important to mention the preparation of a draft Decree entitled "the Waste [APPLICATION FORM FOR WASTE MANAGEMENT PERMIT FOR OPERATION OF INDIVIDUAL/COLLECTIVE WASTE MANAGEMENT SYSTEM FOR CONSTRUCTION AND DEMOLITION WASTE (CWS)] Decree of 2024", pursuant to Regulation 13(2)(a), which sets out the details and information required in the application for a Waste Management Licence for the Operation of an Individual or Collective Waste Management System from Construction and Demolition (WMS), which is expected to be issued shortly.

At the same time, in the framework of the work of the Technical Committee, established following the decision of the Council of Ministers to promote the use of recyclable materials resulting from the processing of WEEE in the context of the implementation of the circular economy, the following actions were implemented.

ii. Amend the Order, the Basic Requirements (Construction Products) Regulations, to enable the use of recyclable materials to be used for backfill and backfill operations with CPR 338/2023 (20/9/2023).

iii. The text of the changes to the technical specifications, which is being prepared by the Public Works Department to promote the use of recycled materials in public works construction, has been completed and is in the process of being finalized and forwarded to the Bid Branch of that Department so that it can be included in the new projects to be advertised. The definition of limits and procedures for the control of hazardous substances contained in recycled materials is pending and it is under investigation what is applied in other European EU member countries, which can be applied to our data.

iv. The Geological Survey Department has advanced procedures for approval of the "Sampler" Service Plan, under which action will be taken to recruit additional staff specifically for Market Surveillance and quality control of recycled products produced.v

v. The creation of a single multi-divisional platform (software) to collect information on excavation waste management and management of produced materials is being promoted. The aim is to provide direct information to the services involved for their rational management. The technical consultant/expert has already been recruited in order to prepare the tender notice for the selection of the platform implementer with the required data.

In the context of prevention, reduction, proper management of WEEE, achievement of the recycling targets and control of reduction, uncontrolled dumping in fields, streams or landfills and in the context of the implementation of the circular economy, the Ministry will continue its actions towards the rational management of WEEE, implementing the existing legislation.

In addition, the Ministry, as part of its efforts to continuously optimise the legal framework, is also studying and evaluating new good practices of the circular economy, such as Extended Producer Responsibility schemes, which through a set of measures ensure that any producer or importer of building products bears financial and organisational responsibility for the management of the waste of this product at the end of its life cycle. In this context, a workshop on "Effective Management of Construction and Demolition Waste" was held on 16/5/2024, where experts were invited on behalf of the French ecological organisation "Ecominero", who presented the good management practices of clean WEEE applied in France, including the implementation of a producer responsibility system for WEEE.

In conclusion, it is noted that the Ministry is implementing the existing legislation, taking into account current challenges, reinforcing and supporting the general need for sustainable development and promoting the circular economy in the management of construction and demolition waste.

Finally, it should be noted that instructions were given from the outset by the Minister of Agriculture, Rural Development and Environment to reply to the letter and arrange a meeting and briefing of the OAC in her presence. The meeting was arranged for Friday, 12/7/2024.
