Based on Article 139 of the Constitution, which challenges legislative regulations introduced by the Parliament through the 2022 Budget

The Attorney General of the Republic, Mr. George Savvidis, on the instructions of the President of the Republic Mr. Nicos Anastasiades, today registered an appeal to the Supreme Court, based on Article 139 of the Constitution, challenging legislative regulations introduced by the House of Representatives through the 2022 Budget Law of 2021, Law 56(II)/2021.

Specifically, these regulations concern the termination status of the term of office of the associates/advisers of the Government, the President of the Republic, the Ministers, the Deputy Ministers, the Government Spokesperson and the Speaker of the House of Representatives, as well as the remuneration of advisers/associates in the event that they are seconded from the position of a civil servant, or an employee of a public law body, or an employee of indefinite duration employed by the Civil Service or a public law body.

The action raises a conflict of jurisdiction based on a breach of the principle of the separation of powers deriving from the Constitution, a breach of European Union law relating to the framework agreement on fixed-term work (Directive 1999/70/EC) and a challenge to authority based on a breach of the constitutional principle of freedom of association and equal treatment.
