The Minister for Agriculture, Rural Development and the Environment exercising the powers conferred on him by regulation 6(1) of the Control of Atmospheric Pollution (Unlicensed Premises) Regulations 2004 to 2021 made the Control of Atmospheric Pollution (Unlicensed Premises) (Annual Report) Order 2022 (C.DECREE 38/2022).
Under these Regulations, operators of unlicensed premises are required to submit an annual report.
Note that under the Regulations, operators of small capacity (< 1 MW) combustion facilities are exempt from the requirement to submit an annual report.
The annual report must be submitted to the Department of Environment by the end of March each year by operators of unlicensed facilities and must include data for the previous year.
The Control of Atmospheric Pollution (Unlicensed Installations) (Annual Report) Order 2019 is repealed.
