We will continue the opening in Varosha, says Tatar commenting on President Anastasiades' statement on "legal trap"
The initiative on Varosha will continue with determination, with respect for property rights and within the framework of the ECHR decisions, the TC leader said, commenting on the President's recent statements and the description of the "property commission" as a "legal trap".
As reported in the occupied territories, in a written statement yesterday afternoon, Ersin Tatar linked President Anastasiades' statements to the 2023 presidential elections and claimed that they targeted candidates who encouraged the E/C from Varosha to apply to the "real estate committee", saying that the President of the Republic had characterized as wrong - as he said - the appeal of E/C to this "committee".
To support this claim, he said. Tatar meaning Anastasiades' reference to a "legal trap" has been described (by the E/C leadership) as a negative development by the decision of the "committee" to make EVKAF an interested party in an application concerning Varosha.
According to the ECHR, the TC leader added, the "real estate committee", which continues to carry out its activities as an effective domestic remedy, is handling the applications raised by the Varosha initiative "in an efficient and timely manner", he claimed.
This decision, he continued, is based on a procedure contained in the "legislation" of the "committee", which has been reviewed by the ECtHR and created taking into account the principles of natural justice, and which allows the "committee" to make a final decision after hearing the arguments of all parties concerned.
"Justice requires that all parties involved be duly heard. To attempt to prevent this is to attempt to prevent the administration of justice. A similar decision of the Real Estate Committee, which accepted the, Administration of Foundations (EBKAF) as an interested party was previously reviewed and approved by the three-judge Supreme Administrative Court," Ersin Tatar said, referring to institutions of the pseudo-state.
While this is the situation, Tatar said, he argued that President Anastasiades calling a "tactical and procedural decision" of the "committee" a "negative development" is an "untenable argument". "Ignoring the legal facts, the aim of the E/C leader once again is not to resort to legal remedies that respect the property rights of the E/C residents, but to score political points with false statements," he claimed.
The "real estate committee" is not a legal trap, he said.
The "real estate committee" is not a legal trap, he said. Tatar, but just the opposite, "an effective mechanism that ensures access to property rights for all beneficiaries, including former residents, in accordance with the European Convention on Human Rights."
He concluded by saying that the pseudo-state would resolutely pursue the Varosha initiative, meaning the opening of the fenced area of Famagusta.
