In a statement, the Legal Service said that the Attorney General of the Republic, Mr. George Savvidis, following instructions from the President of the Republic Mr. Nicos Anastasiades, registered today an appeal to the Supreme Court, based on Article 139 of the Constitution, which challenges legislative regulations brought by the House of Representatives through the Budget of 2022, Law of 2021, Law 56(II)/2021.
Specifically, these regulations relate to the termination status[/B] of the tenure of the associates/advisers of the Government, the President of the Republic, the Ministers, the Deputy Ministers, the Government Spokesperson and the Speaker of the House of Representatives, as well as the remuneration of advisers/associates in the event that they are seconded from the position of a civil servant, or an employee of a public law body, or an employee of indefinite duration employed by the Civil Service or a public law body.
The action raises a conflict of powers on account of a breach of the principle of the separation of powers deriving from the Constitution, a breach of European Union law relating to the framework agreement on fixed-term work (Directive 1999/70/EC) and a challenge to authority on account of a breach of the constitutional principle of freedom of contribution and equal treatment.
