A blow to US President Joe Biden has been dealt by the Supreme Court, overturning his decision to impose mandatory vaccination of workers in businesses employing more than 100 people. The Supreme Court nevertheless held valid the mandatory vaccination for Covid-19 of those working in federally funded health care facilities.

The federal Occupational Safety and Health Administration (OSHA) had issued a ruling that applied to businesses employing at least 100 workers, requiring either vaccination or weekly testing for Covid-19. The policy affected more than 80 million employees and was supposed to go into effect on Monday.

But the State of Ohio and a business association appealed to the Supreme Court seeking its invalidation and were vindicated. By a vote of 6 (all conservative justices) to 3 (liberals), the Supreme Court blocked the implementation of a Cincinnati Court of Appeals decision that had given the green light as of December 17 for the vaccinations to proceed.

The other order, which the Supreme Court ruled valid by a vote of 5 (three liberal and two conservative justices) to 4 (the remaining conservative justices), involved the vaccination of some 10.3 million workers in 76.000 health care facilities, such as hospitals and nursing homes, that receive money from the Medicare and Medicaid insurance programs for the elderly, disabled and low-income Americans.

Workers at these facilities must be vaccinated by the end of February.
