Issue of a new Order regarding the submission of an annual report on unlicensed installations under the Air Pollution Control Laws
Under the Air Pollution Control Laws 2002 to 2021, the Minister of Agriculture, Rural Development and Environment, in exercise of the powers conferred on him by regulation 6(1) of the Control of Atmospheric Pollution (Unlicensed Premises) Regulations 2004 to 2021, made the Control of Atmospheric Pollution (Unlicensed Premises) (Annual Report) Order 2022 (C.Decree 38/2022).
Under these Regulations, operators of unlicensed installations are required to submit an annual report.
Unlicensed facilities fall into the following categories:
(a) ready-mixed concrete production facilities,
(b) facilities in which grinding, screening, conveying, mixing, storage, packaging, drying or other physical treatment processes are carried out, and
(c) small combustion facilities (< 1 MW).
Note that, under the Regulations, operators of small combustion plants (< 1 MW) are exempt from the annual reporting requirement.
The annual report must be submitted to the Department of Environment by the end of March each year by operators of unlicensed installations and must include data for the previous year.
The Control of Atmospheric Pollution (Unlicensed Installations) (Annual Report) Ordinance 2019 is repealed.
